1. Overview

Welcome to Maison Memnoon.

These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, and related services (collectively, the “Services”).

By visiting our website or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

These Terms apply in addition to our Privacy Policy, Shipping Policy, and Return Policy.

Nothing in these Terms limits mandatory rights available to consumers under applicable law.

Maison Memnoon garments are produced in our family atelier in Istanbul, Turkey. Sales, fulfillment, and distribution operations for customers are handled through our Germany-based operational partner.

2. Eligibility

You may use our Services only if you are legally capable of entering into binding contracts under applicable law.

If you place an order on behalf of another person or entity, you confirm that you have authority to do so.

3. Products

We make reasonable efforts to display product descriptions, colors, measurements, and images as accurately as possible.

However:

  • colors may vary depending on screen settings and devices

  • handmade or natural fabrics may contain slight variations

  • measurements may vary within normal tolerances

  • product availability may change without notice

Minor variations do not automatically constitute defects where legally permissible.

4. Orders and Contract Formation

Product listings on our website are invitations to place an order and do not constitute binding offers.

By submitting an order, you make a binding offer to purchase the selected products.

We may accept your order by:

  • sending an order confirmation that expressly confirms acceptance, or

  • dispatching the goods

If we cannot accept an order, we will inform you and refund any payment already made where required.

We reserve the right to refuse orders where fraud, pricing error, stock error, misuse, or unlawful activity is reasonably suspected.

5. Prices and Payment

All prices shown are as displayed on the website at the time of order.

Unless otherwise stated, prices include applicable VAT where legally required.

Shipping costs, customs duties, import taxes, and similar charges may be shown separately or may apply depending on destination country.

Accepted payment methods are displayed during checkout.

We reserve the right to correct obvious pricing errors before contract acceptance.

6. Shipping and Delivery

We ship to selected destinations shown on our website.

Estimated delivery times are non-binding unless expressly agreed otherwise.

Delays may occur due to customs, carriers, weather, strikes, force majeure, or other circumstances beyond reasonable control.

For consumers, risk of accidental loss or damage passes upon delivery to you or a person designated by you, except where applicable law provides otherwise.

If you are a business customer, risk may pass upon handover to carrier where legally permissible.

7. Right of Withdrawal for Consumers

If you are a consumer residing in the EU, EEA, or where similar rights apply, you may have a statutory right of withdrawal.

Your statutory consumer rights remain unaffected.

8. Returns and Exchanges

Returns and exchanges are handled according to our Return Policy.

Nothing in that policy limits mandatory statutory rights, including rights relating to defective goods where applicable.

9. Retention of Title

Goods remain our property until full payment has been received, to the extent permitted by applicable law.

10. Customer Accounts

If customer accounts are offered:

  • you are responsible for maintaining login confidentiality

  • information provided must be accurate

  • unauthorized use must be reported promptly

We may suspend accounts in cases of misuse, fraud risk, or security concerns.

11. Acceptable Use

You agree not to misuse the Services. In particular, you must not:

  • violate laws or third-party rights

  • interfere with website security or operations

  • upload malicious code

  • scrape data unlawfully

  • use false identities fraudulently

  • place fraudulent or abusive orders

We may restrict access where reasonably necessary.

12. Intellectual Property

All website content, branding, text, graphics, logos, designs, photographs, and related materials are owned by or licensed to Maison Memnoon unless otherwise stated.

No rights are granted except the limited right to use the website for personal lawful shopping purposes.

Unauthorized reproduction, resale, or commercial exploitation is prohibited unless legally permitted.

13. Reviews and Feedback

If you submit reviews, comments, or feedback:

  • you confirm the content is truthful and lawful

  • you own or control rights necessary to submit it

  • it does not infringe third-party rights

You grant us a non-exclusive right to use such content for store, editorial, or marketing purposes.

We may remove unlawful, abusive, or misleading submissions.

14. Defects and Legal Guarantees

Consumers benefit from statutory warranty rights for defective goods under applicable law.

Where legally permitted for business customers, warranty rights may be modified only to the extent allowed by law.

15. Liability

We are liable without limitation where required by law, including for:

  • intent

  • gross negligence

  • fraudulent concealment

  • injury to life, body, or health

  • mandatory product liability claims

For slight negligence, we are liable only for breach of essential contractual obligations and limited to foreseeable typical damage, unless mandatory law provides otherwise.

Nothing in these Terms excludes rights that cannot legally be excluded.

16. Third-Party Services

Our store may use third-party providers such as Shopify, payment processors, logistics companies, analytics, or communication tools.

Their separate terms and privacy practices may apply where relevant.

17. Privacy

Personal data is processed according to our Privacy Policy.

18. Force Majeure

We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, strikes, governmental actions, transport disruption, or infrastructure outages.

19. Changes to Services or Terms

We may update website content, products, prices, or these Terms where reasonably necessary.

Updated Terms become effective upon publication for future use of the Services.

Material changes will be communicated where legally required.

20. Governing Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer residing in another country, mandatory consumer protection laws of your country of residence remain unaffected.

21. Dispute Resolution

The European Commission online dispute resolution platform has been discontinued.

We are not obliged and do not commit to participate in consumer arbitration proceedings unless legally required.

22. Severability

If any provision of these Terms is invalid, the remaining provisions remain effective to the extent permitted by law.
